Equity means social justice,
uprightness, decency to right path etc. The above quote is a Latin maximum.
Equity cannot help the indolent for acquiring the justice. Equity will help the
vigilant for acquiring justice in time. Some laws are depending upon limitation
Act 1908. It cannot gives justice to indolent. It is also proverb ignorance of
law is no excuse.
There are various types of law depending upon limitation or time barred for
acquiring the justice. The court shall follows law accordingly. Now who come
first into court and well in time may get the justice. There are some techniques
and benefit goes to petitioner/appellant who is vigilant for justice. The law is
base on ‘audi atum partum’ mean both side of the parties must be hearing.
The court shall not entertain indolent for acquiring the justice. His suit has
been rejected due to delay. There are some exceptional cases which is time
barred not consider. That it is happen due to summer vocations in the civil
court or high court etc. But it is mandatory to file a suit first day of opening
of the high court or other civil courts.
