Yunus bin Jubair said “I asked Abdullah bin Umar “A man divorced his wife while she was menstruating? He said do you know Abdullah bin Umar? He said, yes. Abdullah bin Umar divorced his wife while she was menstruating. So, Umar came to the Prophet صلی ‌اللہ ‌علیہ ‌وسلم and asked him (about this matter). He said Command him to take her back in marriage he may the divorce her in the beginning of the waiting period. I (Ibn Jubair) asked him “Will this divorce be counted? He said “Why not?” If he was helpless and showed his foolishness (that would have been counted).

حَدَّثَنَا الْقَعْنَبِيُّ، ‏‏‏‏‏‏حَدَّثَنَا يَزِيدُ يَعْنِي ابْنَ إِبْرَاهِيمَ، ‏‏‏‏‏‏عَنْ مُحَمَّدِ بْنِ سِيرِينَ، ‏‏‏‏‏‏حَدَّثَنِي يُونُسُ بْنُ جُبَيْرٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ سَأَلْتُ عَبْدَ اللَّهِ بْنَ عُمَرَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ قُلْتُ:‏‏‏‏ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ ؟ قُلْتُ:‏‏‏‏ نَعَمْ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَإِنَّعَبْدَ اللَّهِ بْنَ عُمَر طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ، ‏‏‏‏‏‏فَأَتَى عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهُ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا فِي قُبُلِ عِدَّتِهَا ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ قُلْتُ:‏‏‏‏ فَيَعْتَدُّ بِهَا، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَمَهْ، ‏‏‏‏‏‏أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ.

محمد بن سیرین کہتے ہیں کہ   مجھے یونس بن جبیر نے بتایا کہ میں نے عبداللہ بن عمر رضی اللہ عنہما سے مسئلہ دریافت کیا، میں نے کہا کہ جس آدمی نے اپنی بیوی کو حالت حیض میں طلاق دے دی ہے ( تو اس کا کیا حکم ہے؟ ) کہنے لگے کہ تم عبداللہ بن عمر رضی اللہ عنہما کو پہچانتے ہو؟ میں نے کہا: ہاں، تو انہوں نے کہا: عبداللہ بن عمر رضی اللہ عنہما نے اپنی بیوی کو حالت حیض میں طلاق دے دی تو عمر رضی اللہ عنہ نے نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں حاضر ہو کر مسئلہ دریافت کیا، آپ صلی اللہ علیہ وسلم نے فرمایا: اسے حکم دو کہ وہ رجوع کر لے اور عدت کے آغاز میں اسے طلاق دے ۔ میں نے پوچھا: کیا اس طلاق کا شمار ہو گا؟ انہوں نے کہا: تم کیا سمجھتے ہو اگر وہ عاجز ہو جائے یا دیوانہ ہو جائے ۱؎۔
